Terms & Conditions

These Terms & Conditions apply to purchases, membership transactions and use of the Class 58 Locomotive Group website. By placing an order through our website, you agree to be bound by these terms.

Nothing in these Terms & Conditions affects your statutory rights as a consumer.

2. Using Our Website

You may use this website for lawful purposes only.

You must not knowingly:

  • attempt to gain unauthorised access to the website or its systems;
  • introduce viruses, malware or other harmful material;
  • use automated systems to interfere with the operation of the website;
  • submit false, fraudulent or misleading information; or
  • use the website in a way that infringes the rights of another person or organisation.

3. Products

We make reasonable efforts to ensure that product descriptions, photographs and other information on our website are accurate.

Images are provided for illustrative purposes and colours or appearance may vary slightly depending upon photography, manufacturing variations and the device or screen being used to view the website.

All products are subject to availability.

4. Prices

Prices are shown in pounds sterling (£).

The price payable is the price displayed at the time the order is submitted, subject to correction of obvious errors.

Applicable delivery charges will be shown during checkout before payment is completed.

If a product has been displayed at an obviously incorrect price as a result of a genuine administrative or technical error, we reserve the right to cancel the affected order and refund any payment already made.

5. Placing an Order

Submitting an order through the website constitutes an offer to purchase the products selected.

After an order is placed, you will normally receive an electronic acknowledgement. An automated acknowledgement does not necessarily mean that we have accepted the order.

We reserve the right not to accept an order where, for example:

  • the product is unavailable;
  • payment cannot be authorised;
  • there has been an obvious pricing or product-description error;
  • delivery cannot be made to the address supplied; or
  • we reasonably suspect fraudulent or improper activity.

6. Payment

Online card payments are processed securely through Square.

Payment must normally be received before goods are dispatched.

We do not ordinarily retain complete payment card details entered through Square's payment processing system.

7. Delivery

We currently deliver physical goods to addresses within the United Kingdom only.

In-stock goods are normally dispatched by Royal Mail within 2–3 working days.

Delivery dates are estimates unless we have expressly agreed otherwise with you.

Unless a different delivery period has been agreed, goods will be delivered without undue delay and within the period required by applicable consumer law.

Responsibility for the goods passes to you when the goods are delivered into your physical possession or the possession of a person identified by you to receive them.

8. Pre-Order and Out-of-Stock Products

Products described as pre-order or out of stock may not be available for immediate dispatch.

Any expected availability or dispatch date shown is an estimate and may change due to circumstances outside our control.

If there is a material delay, we will endeavour to provide updated information where practical.

9. Your Right to Cancel

If you are purchasing as a consumer online, you will normally have the legal right to cancel your purchase of physical goods without giving a reason.

The cancellation period normally expires 14 days after the day on which you, or a person nominated by you, takes physical possession of the goods.

To exercise your right to cancel, you must clearly inform us of your decision before the cancellation period expires.

You may contact us by email at [email protected] or write to us at the address shown above.

10. Returning Cancelled Orders

If you cancel an order after receiving the goods, you must return them to us without undue delay and normally no later than 14 days after telling us that you wish to cancel.

Unless the goods are faulty, damaged, incorrect or we have agreed otherwise, you are responsible for the direct cost of returning unwanted goods.

Products should be returned to:

Class 58 Locomotive Group
c/o HAD-GROUP
Unit 2–4 France Ind. Complex
Vivars Way
Canal Road
Selby
North Yorkshire
YO8 8BE

You are responsible for taking reasonable care of the goods while they are in your possession. We may make a deduction from a refund where the value of goods has been reduced as a result of handling beyond what would reasonably be necessary to establish their nature, characteristics and functioning.

11. Refunds Following Cancellation

Where you validly exercise your cancellation rights, we will refund payments due to you in accordance with applicable consumer law.

This normally includes the standard outbound delivery charge paid when the order was placed. If you selected a more expensive delivery method than our least expensive standard delivery option, the additional delivery cost does not have to be refunded.

We may withhold the refund until we receive the returned goods or you provide evidence that you have sent them back, whichever occurs first.

Refunds will normally be made using the same payment method used for the original transaction unless otherwise agreed.

12. Exceptions to Cancellation Rights

The statutory right to cancel does not apply to certain categories of goods.

This may include products that have been:

  • made to your specifications;
  • clearly personalised; or
  • otherwise produced specifically for you where the relevant statutory exception applies.
Pre-order does not automatically mean non-refundable. A product being described as a pre-order or temporarily out of stock does not by itself remove your statutory cancellation rights.

13. Digital Products

Where digital content is supplied by download, different cancellation rules may apply.

If you request immediate access to digital content during the statutory cancellation period, we may ask you to expressly agree to the supply beginning immediately and acknowledge that your cancellation right will be lost once the download or supply begins, where permitted by law.

14. Faulty, Damaged or Incorrect Goods

Your statutory rights in relation to faulty, damaged, misdescribed or incorrect goods are unaffected by these Terms & Conditions.

If there is a problem with an item supplied by us, please contact us as soon as reasonably possible at [email protected].

Depending upon the circumstances and your statutory rights, an appropriate remedy may include repair, replacement, price reduction or refund.

15. Membership

Membership of the Class 58 Locomotive Group may be purchased or renewed through this website.

Membership remains subject to the Group's constitution, membership rules and any applicable approval procedures.

Purchasing membership through the website does not override any provisions of the Group's constitution.

Where an application is not accepted, any membership payment received in respect of that application will be refunded as appropriate.

16. Age Requirements

This website's online purchasing and membership facilities are intended for persons aged 18 years or over.

By placing an order or applying for membership through the website, you confirm that you are at least 18 years old.

17. Intellectual Property

Unless otherwise stated, the content of this website — including text, graphics, logos, design elements and original photographs — is owned by or used with the permission of the Class 58 Locomotive Group and its respective copyright holders.

Content may not be reproduced, distributed or used commercially without permission from the relevant rights holder.

18. Third-Party Content and Links

Our website may contain links to websites operated by third parties.

These links are provided for convenience and information. We are not responsible for the content, availability, security or privacy practices of independent third-party websites.

19. Our Liability

Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Where you are acting as a consumer, we are responsible for losses that are a reasonably foreseeable consequence of our breach of these terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable or for business losses arising from a consumer transaction.

20. Events Outside Our Control

We will not be responsible for delays or failures caused by events outside our reasonable control, including postal disruption, extreme weather, industrial action, transport disruption, failure of third-party systems or other circumstances that could not reasonably have been avoided.

21. Privacy

Personal information supplied through the website will be processed in accordance with our Privacy Policy and applicable data protection law.

22. Changes to These Terms

We may update these Terms & Conditions from time to time.

The terms applicable to an order will normally be those in force when the order was placed.

23. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

If you are a consumer resident elsewhere within the United Kingdom, you may also benefit from mandatory consumer protections and rights to bring proceedings in the courts applicable to your place of residence.
